These factors, and several others, must be carefully considered by the court.
Limitations on Pain and Suffering
In some cases, a court may use what is known as a multiplier to determine pain and suffering damages. This means they’ll multiply a person’s medical bills by a certain number, usually between 1.5 and 4, to determine the amount of general damages a person will receive. It’s important to note, however, that even when using this equation, there are still limitations on pain and suffering compensation.
Many states actually have caps on the amount that a person can receive in pain and suffering damages. It’s important to note, however, that some of these statewide caps only apply to cases involving product liability or medical malpractice. There are even states that will reduce the amount a doctor must pay in a medical malpractice suit based on how much a person’s insurance covered.
Unfortunately, pain and suffering aren’t easily quantifiable, and this means that it can be difficult to determine just how much an injured person deserves.
